Terms and Conditions

Welcome to MB1 Cars. These Terms and Conditions govern the sale of second-hand vehicles by MB1 Cars (“we”, “us”, “our”). By purchasing a vehicle from MB1 Cars, you (“you”, “the Buyer”) agree to be bound by these terms.

1. Definitions

• Seller: MB1 Cars, registered at Sandy Ln, Aveley, South Ockendon RM15 4XL, United Kingdom, Company number 16184109.
• Buyer: Any individual or entity purchasing a second-hand vehicle from the Seller.
• Vehicle: The used motor vehicle listed for sale by the Seller.
• Contract: The agreement formed between Buyer and Seller upon acceptance of these Terms and Conditions and the payment of any deposit or balance.

2. Vehicle Listings and Descriptions

1. Accuracy of Information: We strive to provide accurate descriptions, photographs, and specifications of each Vehicle. However, minor discrepancies may occur and do not constitute a breach of contract.
2. Inspection: Buyers are encouraged to inspect any Vehicle in person or via an independent survey prior to purchase. All inspections must be arranged in advance.

3. Pricing and Payment

1. Pricing: All prices are quoted in GBP and include VAT where applicable.
2. Deposit: A non-refundable deposit of  Shembull 15%  is required to secure a Vehicle. We will not hold a Vehicle without receipt of the deposit.
3. Balance Payment: The remaining balance must be paid in full prior to or upon collection/delivery of the Vehicle.
4. Accepted Methods: Payment options include bank transfer, credit/debit card, or other methods agreed in writing.

4. Contract Formation

1. Offer and Acceptance: An offer is made when Buyer submits a deposit payment. Acceptance occurs when the Seller issues a confirmation email or invoice.
2. Cancellation by Buyer: The deposit is non-refundable. The Buyer may cancel the Contract, but will forfeit the deposit.

5. Delivery, Collection, and Risk

1. Collection: Unless otherwise agreed, Buyers must collect Vehicles from our premises during business hours.
2. Delivery: We offer delivery services at additional cost. Risk of loss or damage transfers to Buyer upon delivery completion at the agreed location.
3. Transfer of Ownership: Legal ownership and risk pass to the Buyer once full payment clears and the Vehicle is released from our premises.

6. Warranty and Disclaimers

1. Statutory Rights: All Vehicles sold are subject to statutory rights under the Consumer Rights Act 2015.
2. As-Is Sale: Unless a separate warranty is agreed in writing, all Vehicles are sold as seen, with no further warranty provided by the Seller.
3. Mechanical Condition: We warrant that each Vehicle is delivered in roadworthy condition and conforms to the MOT certificate if applicable.
4. Exclusions: We do not warrant against wear-and-tear items (e.g., tires, brake pads), or damage arising after sale.

7. Returns and Cancellations

1. Cooling-Off Period: The Buyer has no automatic right to cancel after taking ownership, except for misrepresentation.
2. Defects Claim: If a Vehicle is materially not as described, the Buyer must notify the Seller in writing within 7 days of receipt.
3. Resolution: We will repair, replace, or refund at our discretion, subject to inspection.

8. Limitation of Liability

1. Maximum Liability: Our liability under the Contract is limited to the purchase price paid for the Vehicle.
2. Exclusion of Consequential Loss: We are not liable for any indirect, special, or consequential losses (e.g., loss of earnings).

9. Data Protection and Privacy

1. Personal Data: We collect and process Buyer data in accordance with our Privacy Policy, available at [link].
2. Use of Data: Data is used to process orders, deliver Vehicles, and for marketing if consent is given.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.

11. Amendments

We may update these Terms at any time. We will notify Buyers of significant changes via email or by posting on our website. Continued use constitutes acceptance of the updated Terms.
